DOL NEWS

The latest immigration news from the US Department of Labor is that in early a new ETA 9089 (PERM Labor Certification Form) will be used.  The new form should have space available for explanations which, at least in theory, should cut down on the number of audits.

Also as of the first of the year, the DOL may be taking up to a week to certify Labor Condition Applications (LCAs) that are filed in support of H-1B petitions.  This process is currently done electronically and takes about 30 seconds.  This could potentially pose a problem for last minute H-1B filers.

EMPLOYERS FIGHTING IMMIGRATION CRACKDOWNS

According to an article on nytimes.com:  “Under pressure from the toughest crackdown on illegal immigration in two decades, employers across the country are fighting back in state legislatures, the federal courts and city halls.”

I predict that in 2009 (maybe early 2010) there will be a positive change in immigration policy.  There will be a new President, new Congress and less political pressure.  Common sense practicality will override raw emotion and immigration laws that make sense will be enacted.  My record on predictions is about 50/50, so we’ll have to wait and see.
