According to an article on boston.com:  “Alan was not just a street-smart kid in a baseball cap but a gifted student who breezed through math problems and quoted Milton and Dante. He was a voracious reader, the high school salutatorian, and last month, he graduated from Harvard with a degree in the humanities.”

Another example of why we need Comprehensive Immigration Reform, including the DREAM Act that would allow the undocumented who are here through no fault of their own to legalize their status.  Laws should make sense and should reflect what is right and best for the country.  Deporting a Harvard grad who entered the country illegally as an infant is a lose-lose situation for both Alan as well as for the US.

ONE ANTI-HISPANICS’ POINT OF VIEW

A video on cnn.com includes an interview of a woman living in an Azle, Texas home with a sign that reads: “Hispanics Keep Out”.

This is one extreme view in the immigration debate and unlike many anti-immigrants who may try to conceal their racist views behind a veil of often weak but seemingly logical arguments – this woman in her seventies is sharing what she really thinks. 

Hatred is a very powerful emotion.  This is an example of someone who one could imagine calling her Congressmen and Senators a dozen times daily to make her voice heard against immigration reform.  Is this who our politicians should be listening to?  Just because someone yells the loudest, it doesn’t make her right nor does it make her part of the “majority of Americans”.

POLICE CHIEFS SUPPORT IMMIGRATION REFORM

According to an article on usatoday.com:  “Some of the nation’s top cops on Wednesday called upon Congress to promptly adopt an immigration reform measure, saying local law enforcement agencies across America are struggling to deal with crime and confusion caused by a broken system.”

Common sense dictates that our broken immigration system is a problem that needs to be resolved.  Unfortunately common-sense and cooler heads do not always prevail in DC.  Let us hope that this new Congress does the right thing and passes CIR once and for all.

REPORT: ICE BROKE THE LAW AND ITS OWN REGULATIONS IN RAIDS

According to an article on nytimes.com:  “Armed federal immigration agents have illegally pushed and shoved their way into homes in New York and New Jersey in hundreds of predawn raids that violated their own agency rules as well as the Constitution, according to a study to be released on Wednesday by the Benjamin N. Cardozo School of Law.”

Fortunately, the Obama administration sees the harm in this lawless, ineffective approach to dealing with the immigration crisis.  ICE is now being forced to shift its focus to employers of the undocumented.  For the most part, employers should have the resources to fight back if they are wrongly targeted, unlike those individuals(including US Citizens or those lawfully present) who were rounded up like cattle in the home and workplace raids that took place under the Bush administration.

Our office receives calls on a fairly regular basis from tearful family members of aliens who were detained by ICE wondering where their parent, child or sibling has been taken.  Individuals facing such a predicament should contact their local ICE Office of Detention and Removal Operations for information on where their family member is being held.

USCIS INFORMATION FOR EMPLOYERS WHOSE H-1B PETITIONS FOR HEALTH CARE SPECIALTY OCCUPATIONS HAVE BEEN DENIED

According to a USCIS Press Release:  “If the Form I-129 was denied solely on the basis that the beneficiary did not possess a Master’s or higher degree in the field, the petition may be reopened on service motion and will be adjudicated in accordance with the May 20, 2009 memorandum on “Requirements for H-1B Beneficiaries Seeking to Practice in a Health Care Occupation” (see Related Links section of this page), which provides clarification on the standards for H-1B health care specialty occupations. USCIS will only review denials of petitions for which it has received a written request for review from the petitioning employer or its representative.”

MORE BARK THAN BITE – THE END RESULT OF PASSING COMPREHENSIVE IMMIGRATION REFORM

According to an opinion piece that appeared on latimes.com:  “Our immigration system has been broken for too long, and the costs of that failure are growing. Getting immigration policy right is fundamental to our national interests — our economic vitality, our diplomacy and our national security.”

On the surface, CIR is a tough issue.  It failed to get through Congress…twice.  However the political reality may not be too daunting for our friends in DC were CIR to pass with their support.  Recent elections have shown that the House Representatives who lost their seats in recent elections were those who vocally opposed CIR and favored a restrictionist approach to handling our country’s immigration woes.

Even if those who spend all day calling Congress, writing letters and commenting on blogs and articles threaten to “vote out” members of Congress who support CIR and what they decry as “Amnesty”, let’s look at the reality.  Regardless of how loud a constituent is, how many times she may call or how many letters she may write, she gets only one vote.  Moreover, if the more conservative and possibly less immigrant-friendly of two candidates supports CIR as does the more liberal opposing candidate – who will the anti-immigrants vote for?

On the other hand, the Hispanic population is growing and that demographic’s support for CIR is strong and many among them may, rightly or wrongly, feel that vocal opposition to CIR is nothing short of racism.  Does not do much to help the party that opposes immigration.

Congress should do the right thing:  tackle and pass CIR.  The current system is not working and the politics of the issue do more to harm than good for candidates running for political office.

According to a US ICE News Release:  “U.S. Immigration and Customs Enforcement (ICE) is launching a bold, new audit initiative today by issuing Notices of Inspection (NOIs) to 652 businesses nationwide – which is more than ICE issued throughout all of last fiscal year. The notices alert business owners that ICE will be inspecting their hiring records to determine whether or not they are complying with employment eligibility verification laws and regulations.”
