USCIS UPDATE ON FILING FEE INCREASE EFFECTIVE 7/30/07 AND COMMENT ON CIS HANDLING OF EB JULY VISA BULLETIN CASES FAQs

The USCIS released yet another update of the filing fee increase set to take place on July 30, 2007.  The average fee increase will be 66%.

Pursuant to the FAQs on the July Visa Bulletin mess released yesterday, I-140 / I-485 concurrent filings received on or after July 30, 2007 must include the new I-140 filing fee.  However, all I-485, I-765 and I-131 applications filed for those EB categories whose priority dates were current per the July Visa Bulletin may file until August 17, 2007 and the filing fees will be the amounts currently in effect.  Petitions or applications filed with the incorrect filing fees or with missing signatures will be rejected.

The USCIS will accept certain applications filed at the wrong service centers and will not reject an I-485 application that is missing the medical exam, they will simply issue a Request for Additional Evidence.

As additional questions arise, more FAQs may be released by the USCIS, I will update the site with more information as it becomes available.
